What is The Choice?

There’s an open spot for a new panelist on Going Roggin and they want it!After sending in their submissions, entrants were chosen for auditions and now we’re down to eight contestants on The Choice.

They’ll battle it out week after week and your votes help decide who moves on.Every contest will appear on The Choice two times. Studio scores and public vote percentages from their two appearances will be added together.

The top four contestants will advance to the semifinals.By the end of The Choice, somebody will earn a role debating Southern California’s hottest sports topics.

The Choice is made weekly on Going Roggin, Saturdays at 3 p.m. and Sundays at midnight.

Official Rules

January 18, 2020 – May 11, 2020

PRELIMINARY INFORMATION:  No purchase necessary. A purchase will not improve your chances of winning. Void outside the KNBC Geographic Viewing Area (defined below) and where prohibited. The Choice Contest (“Contest”) will begin on January 18, 2020 at 12:01 A.M. PT and end on May 11, 2020 at 12:30 A.M. PT (“Contest Period”).  All times in the Contest refer to Pacific Time (“PT”). Odds of winning depend upon the number of eligible entries received.  Contest is subject all applicable federal, state and local laws. Entries will be accepted until February 7, 2020 at 12:00 P.M. PT.

ELIGIBILITY: Open only to permanent, legal United States residents who are physically located in the KNBC geographic viewing area in the counties of Los Angeles, Kern, San Bernardino, Orange, Riverside and Ventura in the state of California (collectively, the “KNBC Geographic Viewing Area”), and who are eighteen (18) years of age or older, as of the start of the Contest Period, and can legally work in the U.S. as of the start of the Contest Period.  Entrants must have a valid U.S. Social Security Number and/or a valid U.S. personal tax identification number. Entrants may not participate in the Contest if they are members of any guild, union or other organization that may prohibit/restrict them from participating in this Contest and/or that would restrict, would require payment, enable a third party to have the right to oppose such entrant’s participation in this Contest, or interfere with entrants’ ability to enter into agreements with Sponsors or their designees, as determined by Sponsors in their sole discretion. Entrants may not participate in the Contest if they have previous professional media experience and such experience may disqualify entrants at Sponsors’ sole discretion.  Entrants must be willing to voluntarily submit to and complete a background check. Officers, directors, and employees of Contest Entities (as defined below), members of these persons’ immediate families (spouses and/or parents, children, and siblings, and each of their respective spouses, regardless of where they reside), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter or win the Contest. Contest Entities, as referenced herein, shall include KNBC, 100 Universal City Plaza, Bldg 2120, Universal City, CA, 91608, NBCUniversal Media, LLC, 30 Rockefeller Plaza, New York, NY 10012 (collectively, “Sponsors”), and each of their respective parent, subsidiary, and affiliate companies, and administrative, advertising, and promotion agencies, and any other entity involved in the development, administration, promotion, or implementation of the Contest. Each entrant agrees this is a Contest and not an employment opportunity. Each entrant agrees this is not a paid opportunity. If you were a Second Round Finalist (as defined below) in 2017 or 2018 and/or appeared as an on- air contestant for The Choice contest in 2017 or 2018, you are not eligible to enter or win this contest (as determined by Sponsors in their sole discretion). Entrants must be available for any interviews and/or on-air tapings on such dates and times specified by Sponsors in their sole discretion and as outlined in these Official Rules.

HOW TO ENTER: To enter the Contest, during the Contest Period, you will be required to submit an original video (“Video”) on the following theme: “Why I should be the next panelist on Going Roggin” (‘Theme”). Video must not be longer than thirty (30) seconds in length.  If Video exceeds (30) seconds in length, only the first (30) seconds will be judged.

Video must have been taken by you, and you must have the permission of any person who appears or is identified in the Video. If any minors appear in Video, the entrant must be that minor’s parent and/or legal guardian. Professional Videos with watermarks are not eligible.

To enter the Contest, during the Contest Period, visit www.NBCLA.com/thechoice (the “Page”) or access the application store on your mobile device, search for “NBC4 Southern California,” and follow the provided instructions to download and install the free NBC4 Southern California mobile app (the “App”). Then, follow the provided instructions to upload your Video to the Page or App and complete and thereafter submit the entry form, which includes your Video, Video title, full name, and email address (the “Entry”). If you choose to submit your Entry via your web-enabled mobile device, data rates may apply.  See your wireless service provider for details on rates and capabilities.  All Entries become the property of Sponsors and will not be acknowledged or returned. The Page and App may be collectively referred to herein as the “Website.”

You must submit the Video as part of your Entry to enter and be eligible for the Contest.  By entering the Contest, entrants grant Sponsors the non-exclusive, royalty-free, and irrevocable rights to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, modify, and otherwise exploit the Videos and to incorporate the Videos in other works in any and all markets and media worldwide in perpetuity.  Entrants warrant that they have the sole and exclusive right to grant such rights to Sponsors and that the Sponsors' reproduction, publishing, displaying, and/or other use of the Videos will not infringe on any rights of third parties, including, without limitation, copyright, trademark, privacy, or publicity, or create claims for defamation, false light, idea misappropriation, intentional or negligent infliction of emotional distress, or breach of contract.  If any Videos contain material that is violent, pornographic, obscene, illegal, inappropriate, or racially or morally offensive or if any Videos do not comply with these Official Rules or meet Sponsors’ standards for any reason, as determined by Sponsors in their sole discretion, such Videos (and the related Entries) may be rejected as ineligible for consideration and/or deleted from the Website. Entries must comply with all applicable laws, rules, and regulations.  Sponsors shall have no obligation to copy, publish, display, or otherwise exploit the Videos. If the use of any Video incurs excessive fees, including but not limited to Guild payments, Sponsors reserve the right to disqualify such Video (and the related Entry).

Sponsors may choose to broadcast on-air and/or display on the Website, a selection of Videos, in whole or in part, as determined by Sponsors in their sole discretion. By entering the Contest, each entrant agrees to the posting of such entrant’s name and Video, in whole or in part, on the Website and/or Sponsors’ social media pages, including but not limited to Twitter, Instagram, and Facebook.

Limit one (1) Entry per person during the Contest Period. Multiple entries received from any person beyond this limit will void all such additional Entries. Entries must be received before February 7, 2020 at 12:00 P.M. PT to be eligible for the Contest. Sponsors’ computer shall be the official timekeeper for all matters related to this Contest. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including but not limited to illegible handwriting, are void and will not be accepted.  Entry constitutes permission (except where prohibited by law) to use entrant’s name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval. 

PRIVACY: Entrants will have the opportunity to receive information from Sponsors and selected partners by checking the appropriate box(es). If, at any time, you no longer wish to receive materials from Sponsors or our partners, please go to our privacy policy, located at http://www.nbcuniversal.com/privacy, or the applicable partner’s privacy policy and follow the procedures indicated.

SELECTION AND NOTIFICATION OF FIRST ROUND FINALISTS, SECOND ROUND FINALISTS, THIRD ROUND FINALISTS, FOURTH ROUND FINALISTS, GRAND PRIZE WINNER: There will be three (3) rounds of judging: round 1: initial judging to determine the First Round Finalists Entries (defined below); round 2: judging to determine Second Round Finalists (defined below); round 3: public voting and judging to determine Third Round Finalists (defined below) and Fourth Round Finalists (defined below) and round 4: judging to determine the Fourth Round Finalists (defined below) and Grand Prize Winner (defined below). JUDGES (DEFINED BELOW) ARE STRICTLY PROHIBITED FROM VOTING BASED ON THE FOLLOWING: RACE, GENDER, COLOR, RELIGION, SEX, NATIONAL ORIGIN, AGE, MARITAL STATUS, DISABILITY, MEDICAL CONDITION, SEXUAL ORIENTATION, CITIZENSHIP OR ANY OTHER BASIS PROTECTED BY APPLICABLE FEDERAL, STATE OR LOCAL LAW, ORDINANCE OR REGULATION.

Voters (defined below) are encouraged to vote based on merit and in accordance with the Judging Criteria and the voting rules and without regard to the impermissible categories listed above. If it is brought to the attention of Sponsors that a Voter has voted using any criteria other than the Judging Criteria, or otherwise in violation of these Contest Rules, his/her vote will be disqualified.     

Round 1: Initial Judging for the First Round Finalists: On or about February 7, 2020, one (1) or more qualified judges selected by Sponsors (“Judges”) will review all eligible Entries received during the Contest Period and select up to twenty (20) first round finalists (“First Round Finalists”, each a “First Round Finalist”) based on the following judging criteria (“Judging Criteria”): Personality (33.4%), Ability to Articulate (33.3%), and Knowledge of Relevant Subject Matter (33.3%). The selection and review process may occur on a rolling basis as Entries are received. In the event of a tie, the Judges will break the tie by selecting the tied entrant who received the highest points from the Judges for Personality to advance to Round 2: Judging to Determine Second Round Finalists. In the event a tie remains, an additional tie-breaking judge will judge the tied Entries using the Judging Criteria to determine which of the tied Entries will advance to Round 2: Judging to Determine the Second Round Finalists. Sponsors reserve the right to pick fewer than twenty (20) First Round Finalists (or none at all) or to extend the Contest Entry Period if the Contest does not receive a sufficient number of eligible and qualified Entries, as determined by Sponsors in their sole discretion.

Round 2: Judging to Determine the Second Round Finalists: On or about February 10, 2020, Sponsors will contact each First Round Finalist and conduct an interview (e.g., on Skype, by phone, or in-person) (“Interview”), after which Judges will select up to eight (8) second round finalists (“Second Round Finalists,” each a “Second Round Finalist”) based on the Judging Criteria. The Interview process may occur on a rolling basis. In the event of a tie, ties will be broken as described with regards to First Round Finalists. Sponsors reserve the right to pick more or fewer than eight (8) Second Round Finalists (or none at all), or to extend the Contest Entry Period if the Contest does not receive a sufficient number of eligible and qualified Entries, as determined by Sponsors in their sole discretion. Sponsors may require and potential Second Round Finalists must be willing to voluntarily submit to and complete a background check as a condition of continued eligibility. Noncompliance within the Sponsor specified time period will result in disqualification. First Round Finalists and/or Second Round Finalists will be required as a condition of continued eligibility to sign an Affidavit of Eligibility, Waiver of Liability, and, except where prohibited, Publicity Release within three (3) days of such notification. Noncompliance within this time period will result in disqualification.

Round 3: Public Voting and Judging to determine the Third Round Finalists and Fourth Round Finalists: Second Round Finalists may be asked by Sponsors to keep the outcomes of Round 3 and Round 4 confidential until the Show (defined below) episode air-date specified by Sponsors. The inability to comply with these confidentiality obligations may result in the disqualification of such Second Round Finalist. Each Second Round Finalist will be randomly assigned a seed and will compete “bracket-style” on-air on “Going Roggin” (the “Show”) according to their seed assignment and the chart below (which is subject to change).                                                                                                                         

Host Fred Roggin will ask each Second Round Finalist one (1) or more questions on-air (the “On-Air Debate”) and will judge each Second Round Finalist based on the Judging Criteria.

Each On-Air Debate will also be posted on the Website for public viewing and voting during the applicable Voting Period (as outlined in the chart above). During the applicable Voting Period, visitors to the Website (“Voters”) may vote for their favorite Second Round Finalist (the “Public Vote”) according to the Judging Criteria, voting rules, and procedures established by the Sponsors, which will be posted on the Website (“Vote”). Visitors will be limited to one (1) Vote per day, but Sponsors reserve the right to change the limit on the number of Votes allowed, in their sole discretion. Notification regarding any such change to the Vote limit will be announced on the Website.  Following the first round of debates, contestants will reseeded based upon point totals from their first appearance. Point totals will determine whom Second Round Finalists debate in the second appearance, with the highest point total facing the eight highest total, second facing seventh, third facing sixth and fourth facing fifth. If the reseeding aligns a Second Round Finalist against the same Second Round Finalist they faced in the first On-Air Debate, Sponsors have the right to alter the matchups to ensure a new opponent. While the sponsor reserves the right to change the format for the second appearance, Second Round Finalists will likely abide by the same format as their first appearance. After each Second Round Finalist has participated in two On-Air Debates, the four (4) Second Round Finalists with the highest cumulative scores, based on the Public Vote (50%) and the Judging Criteria (50%), will be deemed the third round finalists (“Third Round Finalists”, each a “Third Round Finalists”). If the tabulation of point totals results in a tie for fourth place, a tiebreaking on-air debate will be scheduled. The tiebreaking debate will be judged solely by the Sponsors, without public vote, based upon the previously prescribed criteria. In the event of a tie for first, second or third place, the tie will be broken in favor of the contestant with the higher cumulative studio score.

Round 4: Judging to Determine the Fourth Round Finalists and Grand Prize Winner: The four (4) Third Round Finalists will be randomly paired up by Sponsors and will compete in pairs in an On-Air Debate (the “On-Air Debate Semifinals”). The first pair of Third Round Finalists will compete in On-Air Debate Semifinals currently scheduled for April 23, 2020. The second pair of Third Round Finalists will compete in On-Air Debate Semifinals currently scheduled for April 30, 2020. The Judges will judge the Third Round Finalists based on the Judging Criteria and select one (1) Third Round Finalist from each pair (“Fourth Round Finalist”, collectively the “Fourth Round Finalists”) to compete in the final On-Air Debate (the “On-Air Debate Finals”). In the event of a tie, ties will be broken as described with regards to First Round Finalists. The two (2) remaining Fourth Round Finalists will compete in the On-Air Debate Finals currently scheduled for May 7, 2020. The Judges will judge the Fourth Round Finalists based on the Judging Criteria and select one (1) grand prize winner (“Grand Prize Winner”). In the event of a tie, ties will be broken as described with regards to First Round Finalists. Grand Prize Winner will be required as a condition of continued eligibility to sign Contest Documents within three (3) days. Noncompliance within Sponsors’ specified time period will result in disqualification. Decisions of Sponsors and Judges are final and binding with respect to all matters related to the Contest. Winning is subject to verification of eligibility.

PRIZE:  There will be one (1) grand prize awarded (“Grand Prize”) to the Grand Prize Winner. Grand Prize consists of one (1) appearance on the Show and the potential opportunity to appear on future episodes of the Show as a contributor.

Estimated Retail Value (“ERV”) of Grand Prize is zero dollars ($0). Actual Retail Value (“ARV”) of Prize may vary. Any difference between ERV and ARV will not be awarded.

Sponsors will determine and will be responsible for all details of Prize in their sole discretion.  Sponsors reserve the right to substitute Prize (or portion thereof) with a similar prize (or prize element) of comparable or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Grand Prize Winner. Prize cannot be transferred by Grand Prize Winner or redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Grand Prize Winner. If Prize is unclaimed within a reasonable time after notification from Sponsors, as determined by Sponsors in their sole discretion, it will be forfeited, and time permitting, an alternate Grand Prize Winner may be selected from the remaining eligible entries at Sponsors’ sole discretion. 

Second Round Finalists, Third Round Finalists, and Fourth Round Finalists must be able to travel on such dates as specified by Sponsors in their sole discretion from February 2020 through May 2020 and as outlined on the chart above (or on such other dates designated by Sponsors).

RECORDING: Sponsors, in their sole discretion, may choose to record and/or broadcast the On-Air Debates and/or Submissions of all Second Round Finalists on the Show. If Sponsors, in its sole discretion, elects to incorporate any such audio and/or video recordings (the “Recordings”) into Show or other television shows, the Recordings will not be considered an employment opportunity, and Second Round Finalists will not be entitled to compensation or credit thereof. Sponsors will determine the nature of the Recordings in their sole discretion. If the Recordings are broadcast, such broadcast will be at a time, for a length of time, and on a date determined by Sponsors in its sole discretion. Second Round Finalists may be required to return completed and signed appearance releases, confidentiality agreements and such other documents as may be required by Sponsors prior to their On-Air Debate on the Show and/or Grand Prize Winner and participation in the segment or rehearsal, if any. Failure of Second Round Finalists to complete and execute these documents in a timely manner, as determined by Sponsors in their sole discretion, may cause On-Air Debate opportunity and/or Prize to be forfeited. The content of the Recording as, and if, finally exhibited and the number of exhibits and re-airs thereof, if any, will be determined by Sponsors in their sole discretion. Second Round Finalists will not have a right of review, notice, or approval of the content of the Recordings or any exhibition or exploitation thereof. Sponsors has the right, in their sole discretion, to disqualify First Round Finalists, and cause Prize to be forfeited, and remove Second Round Finalists from the Show at any time, if any behavior of any Second Round Finalist is deemed by Sponsors to be disruptive or if it may or does cause damage to person, property, or reputation of Sponsors or if it otherwise violates the policies of Sponsors, or if Second Round Finalists do not follow the directions of Sponsors at all times. These Official Rules and the Contest itself are neither a contract nor an application for employment.

CONDITIONS: By entering the Contest, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators (a) to release and hold harmless Contest Entities and each of their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof (including any travel related thereto); (b) to indemnify Released Parties from any and all liability resulting or arising from the Contest and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by Prize supplier that are sent along with Prize; (c) if selected as Grand Prize Winner, to the posting of such entrant’s name on Website and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Contest itself, and to be bound by all decisions of the Sponsors, which are binding and final.Failure to comply with these conditions may result in disqualification from the Contest at Sponsors’ sole discretion. At Sponsor’s request, potential Grand Prize Winner must be willing to sign an affidavit attesting that such entrant meets all of the foregoing eligibility requirements and possibly undergo a background check conducted by Sponsor.

ADDITIONAL TERMS: Sponsors reserve the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules.  Any attempt to deliberately damage the Contest or the operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules.  Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Contest. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsors reserve the right to cancel, modify, or suspend the Contest or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules).  In the event of cancellation, modification, or suspension, Sponsors reserve the right to select Grand Prize Winner in a random drawing from among all eligible, non-suspect entries received prior to the time of the event warranting such cancellation, modification, or suspension.  Notice of such cancellation, modification, or suspension will be posted at Website.  Sponsors may prohibit any entrant or potential entrant from participating in the Contest, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or Sponsors’ agents or representatives; or behaves in any other disruptive manner (as determined by Sponsors in their sole discretion).  Sponsors reserve the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Contest.

DISPUTESThe Contest is governed by, and will be construed in accordance with, the laws of the State of New York, and the forum and venue for any dispute shall be in New York, New York. If THE controversy or claim is not otherwise resolved through direct discussions or mediation, it shall THEN be resolved by FINAL AND binding arbitration administered by JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (“JAMS Rules”).  The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be experienced and licensed to practice law in new york.  All proceedings brought pursuant to this paragraph will be conducted in the County of new york.  THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
